Female athletes get good news in another Title IX suit

A school’s decision to eliminate its women’s equestrian team led to a lawsuit, and the latest ruling in the case is not what the school wanted.

Fifteen of the 21 members of the Delaware State University’s women’s equestrian team sued the school, claiming the university’s decision to eliminate the team at the end of the 2009-10 school year violated Title IX. The team members say the school’s not giving females equal opportunities to participate in varsity sports.

Initial proceedings led to an agreement to keep the team intact at least until the end of the 2010-11 academic year. And in the latest development, the court allowed the case to proceed as a class action. That means it’s now being pursued on behalf of not just the 15 team members who filed the suit but also “all present, prospective, and future” female students who want to participate in intercollegiate athletics as a member of a Delaware State University team.
